Vielmehr ist sie historisch kontingent. Als in den Jahren 1896 und 1909 die ersten deutschen Gesetze gegen den unlauteren Wettbewerb erlassen wurden, galt als Schutzzweck dieses Rechtsgebiets allein der Mitbewerberschutz. Der Schutz der Allgemeinheit, später auch der Verbraucherschutz wurden erst allmählich als eigenständige Schutzzwecke des Lauterkeitsrechts anerkannt. Gerade angesichts der aktuellen kontroversen Schutzzweckdiskussion auf europäischer Ebene erscheint es als Desiderat der Forschung, die Entwicklung und Entfaltung der wettbewerbsrechtlichen Schutzzwecktrias zu analysieren.
Within the global phenomenon of the (re)emergence of religion into issues of public debate, one of the most salient issues confronting contemporary Muslim societies is how to relate the legal and political heritage that developed in pre-modern Islamic polities to the political order of the modern states in which Muslims now live. This work seeks to develop a framework for addressing this issue. The central argument is that liberal theory, and in particular justice as discourse, can be normatively useful in Muslim contexts for relating religion, law and state. Just as Muslim contexts have developed historically, and continue to develop today, the same is the case with the requisites of liberal theory, and this may allow for liberal choices to be made in a manner that is not a renunciation of Muslim heritage.

Der Bruch von Völkervertragsrecht durch den deutschen Gesetzgeber in Gestalt des Treaty Overriding ist ein verbreitetes Phänomen im Bereich des Internationalen Steuerrechts. Dieses Buch erfasst das Treaty Overriding in seiner einfach-, völker- und verfassungsrechtlichen Dimension und entwickelt einen verfassungsrechtlichen Rahmen für dieses gesetzgeberische Vorgehen. Der Autor zeigt, dass aus der u.a. vom Bundesverfassungsgericht in mehreren Entscheidungen betonten, als Verfassungsgrundsatz einzuordnenden Völkerrechtsfreundlichkeit des Grundgesetzes eine nach Regelungsbereichen «abgestufte Bindungswirkung» für den Gesetzgeber abzuleiten ist. Anhand dieses Maßstabs überprüft er zwei Treaty Overriding-Vorschriften auf ihre Vereinbarkeit mit dem Verfassungsrecht. Der Treaty Overriding-Beschluss des Bundesverfassungsgerichts vom 15.12.2015 wird auf Grundlage der Untersuchungsergebnisse bewertet.
Der Vergleich der Gesellschaftsrechtsordnungen hat neue praktische Relevanz gewonnen. Die Arbeit untersucht die deutsche und eine wichtige romanische Gesellschaftsrechtsordnung, die italienische. Im Mittelpunkt steht die Frage nach der Ergebnisbeteiligung eines Gesellschafters. Ausgangspunkt ist die Vorschrift zum patto leonino des Codice civile. Diese besagt: «Die Vereinbarung, nach der einer oder mehrere Gesellschafter von jeder Beteiligung am Gewinn oder an Verlusten ausgeschlossen sind, ist nichtig». Die Norm greift die societas leonina nach Römischem Recht auf. Sie berührt grundsätzliche Fragen der gesellschaftsrechtlichen Dogmatik. Die Untersuchung steht exemplarisch für eine rechtsvergleichende Auseinandersetzung mit dem romanischen Rechtskreis. Das deutsche Gesellschaftsrecht folgt einer liberaleren Logik. Nur im Recht der stillen Gesellschaft ist die Ergebnisbeteiligung eines Gesellschafters konstitutiv für das Vorliegen einer Gesellschaft. Zumindest im Recht der Personenhandelsgesellschaften erscheint es lohnenswert, wie im italienischen Recht über die Vermittlung der Gesellschafterstellung «über das Ergebnis» als alternatives Kriterium nachzudenken.
