Eduard Gans (1797-1839) gehörte in den Zeiten des Vormärz zu den führenden Hegelschülern an der heutigen Humboldt-Universität zu Berlin und galt gar als der große Widersacher von Karl Friedrich von Savigny und der römischen Rechtsschule. Neben seiner wohl berühmtesten Vorlesung «Naturrecht und Universalrechtsgeschichte» hielt er seit dem Sommersemester 1834 ein Kolleg zum Positiven Völkerrecht. Die Arbeit vereint zwei Vorlesungsmitschriften zum Positiven Völkerrecht in einer Edition, um so den Vortrag Gans’ möglichst vollständig rekonstruieren zu können. Der Leser erhält einen Überblick über die Völkerrechtsfragen jener Zeit. Gleichzeitig vermittelt die Edition Gans’ umfassende Geschichtskenntnis, die in dieser Vorlesung anhand der verschiedensten Beispiele zum Tragen kommt. Im Rahmen ihrer Einführung setzt sich die Autorin mit dem Schaffen Eduard Gans’ und seinem Völkerrechtsverständnis im Vergleich zu Hegel auseinander.

The age-old debate about what constitutes just punishment has become deadlocked. Retributivists continue to privilege desert over all else, and consequentialists continue to privilege punishment's expected positive consequences, such as deterrence or rehabilitation, over all else. In this important intervention into the debate, Leo Zaibert argues that despite some obvious differences, these traditional positions are structurally very similar, and that the deadlock between them stems from the fact they both oversimplify the problem of punishment. Proponents of these positions pay insufficient attention to the conflicts of values that punishment, even when justified, generates. Mobilizing recent developments in moral philosophy, Zaibert offers a properly pluralistic justification of punishment that is necessarily more complex than its traditional counterparts. An understanding of this complexity should promote a more cautious approach to inflicting punishment on individual wrongdoers and to developing punitive policies and institutions.

Schon vor den Änderungen durch das 6. StrRG waren diese Begriffe umstritten, was der Gesetzgeber des 6. StrRG – insbesondere wegen der Einführung des Begriffs der gefährlichen Werkzeuge in den Normen des § 244 und § 250 – nicht zu beseitigen vermochte. Vielmehr wurde die Diskussion noch verschärft. Der Autor analysiert den unübersichtlichen Streitstand in Literatur und Rechtsprechung und entwickelt einen zwischen den Qualifikationsnormen des Diebstahls und des Raubes differenzierenden Ansatz zur Lösung der Problematik.

Darf der angegriffene Eigentümer den Dieb erschießen, der mit der Beute flieht? Nach der immer noch herrschenden Meinung wird diese Frage unter der Annahme bejaht, daß der Angriff «nicht geringfügig» bzw. «nicht unerheblich» ist. Wie ist eine solche Meinung entstanden, nach der ein Angriff auf das Eigentum prinzipiell mit derselben Gewalt wie ein Angriff auf das Leben abgewehrt werden darf? Dieser Frage wird rechtssystematisch, rechtsphilosophisch und rechtshistorisch nachgegangen. Insbesondere wird eine «verdrängte» Aufklärung des Strafrechts rekonstruiert, die für eine Auffassung der Notwehr plädierte, in der das Leben des mit der Beute fliehenden Diebes stark geltend gemacht wird. Wichtige Komponenten dieser erfolglosen Tradition sind der Ansatz von von Globig und Huster aus dem Jahre 1783 und der Ansatz des § 427 des Entwurfs des Allgemeinen Gesetzbuchs von 1786. Beide Ansätze thematisieren die strukturelle Ungleichheit in der Gesellschaft. Damit knüpfen sie an Beccarias «Über Verbrechen und Strafen» an.

Dieses Buch befasst sich mit ausgewählten Neuerungen des Bilanzrechtsmodernisierungsgesetzes («BilMoG»). Es widmet sich vor allem den in der Literatur diskutierten bilanz- und gesellschaftsrechtlichen Problemen der neuen Ansatzrechte und der entsprechenden Ausschüttungssperren sowie deren Auswirkungen auf grundlegende bilanzrechtliche Prinzipien. Vergleichend prüft der Autor die kalifornische Rechtsentwicklung in diesem Gebiet. Vor den jüngsten, politisch motivierten Änderungen hatte Kalifornien als einer der wenigen US-Amerikanischen Staaten ein dem deutschen Rechnungslegungsrecht vergleichbares System und damit auch verwandte Umsetzungs- und Anwendungsprobleme. Auf Basis seiner komparativen Analysen erläutert der Autor, dass Ansatz- und Ausweiswahlrechte die Anwendung des Bilanzrechts und die Bilanzanalyse unnötig verkomplizieren und plädiert für ihre Abschaffung.
