The people of the Tilhqotin Nation govern their lands according to dechen ts'edilhtan, the laws of their ancestors. In Canada, Indigenous law is often either misunderstood, disregarded, or simply invisible to non-Indigenous people. Indigenous Law in Context investigates the legal order of one First Nation as it applies to water governance: the sustainable use of and access to surface water within Tilhqotin traditional territory in the Chilcotin region of British Columbia. Canadian society as a whole has moved some way toward accepting Indigenous authority in sociocultural contexts, yet the Canadian state undeniably continues to assume a dominant status in law making. Given this reality, is an Indigenous decision-making process possible when it comes to management of a precious resource? Alan Hanna explores the intersections and points of conflict inherent in Indigenous, provincial, and federal government legal approaches. He analyzes portions of the Tilhqotin Nations oral tradition and knowledge from Elders, gleaned through years of interviews.
