The Eleventh Edition of The Law of Public Education, a textbook-casebook, incorporates recent developments in K-12 Education Law into its conceptual framework by offering updated analysis of major topics in the field. Among its more than 5,000 footnotes, the Eleventh Edition includes citations to more than 600 new cases since 2018 plus substantive discussions of many of these disputes. The volume also adds five new opinions, four of which are from the Supreme Court, among its 123 case excerpts as selected older cases are culled, such as two in Chapter 14 on student speech, replacing them with more up-to-date opinions on cutting edge issues. New case excerpts examine timely developments on the parameters of state aid to faith-based educational institutions and prayer by public employees at work Chapter 2; the limits on the liability of school officials for a student’s off-campus death in Chapter 7; fair share fees for unions in Chapter 9; and student off-campus speech on social media in Chapter 14. The cases included at the end of the chapters are designed to enhance the book’s usefulness both as a teaching tool and as a reference volume to provide a starting point for further research. Selected older cases remain for their longstanding precedential value because they provide a sense of the historical development in the law. Citations continue to include references to West’s Education Law Reporter, when available, thereby making it easier for instructors, students, practitioners, and other readers to locate cases and materials.
